Please read these Terms carefully before using this site. The site is owned and controlled by Avengers Cleaning Services, LLC. By accessing this site in any way, including, but not limited to, browsing this site, using any information, and/or submitting information to Avengers Cleaning Services, LLC, you hereby expressly acknowledge and agree to and are bounded by the terms, conditions, policies, and notices contained in the Terms. You also acknowledge that any hyperlinks or other redirection tools taking you to other sites operated by third parties that appear on the website are not controlled by Avengers Cleaning Services, LLC and do not form part of our website. You agree that you will not hold Avengers Cleaning Services, LLC liable in any way or accountable for anything that occurs on any third-party site. From time to time, we may update this site and the terms. Your use of this site after we post any changes to these terms constitutes your agreement to those changes. This site is offered and available to users who are at least 18 years or older (or over the legal age of majority in your jurisdiction). By using this site, you represent and warrant that you meet all of the foregoing eligibility requirements. These requirements include but not limited to that: (a) you are at least 18 years old, are at least of the legally required age in the jurisdiction in which you reside, and are otherwise capable of entering into a binding contracts and (b) you have the right, authority and capacity to enter into this agreement and to abide by the terms and conditions of this agreement, and that you will so abide, whether you enter into this agreement on behalf of a company or other organization, you represent and warrant that you have authority to act on behalf of that entity and to bind that entity to this agreement. If you do not meet all of these requirements, you must not access or use the site. If you do not understand any part of the Terms, you should seek independent legal advice.

Binding Arbitration:

The Terms and Conditions provide that all disputes, controversies, or claims arising between you and Avengers Cleaning Services, LLC will be resolved by Binding and Final Arbitration. Accordingly, you agree to give up your right to go to court (including in a class action proceeding) to assert or defend your rights (except for matters that may be taken to small claims court or as it relates to provisional or injunctive relief). Your rights will be determined by a Neutral Arbitrator and not a judge or jury and your claims cannot be brought as a class action. Please review the section below entitled Arbitration Agreement for the details regarding your agreement to arbitrate any and all disputes with Avengers Cleaning Services, LLC.

Please read our Privacy Policy for a description of our privacy practices and policies. Our Privacy Policy is a part of these Terms, and you agree to our use and disclosure of the information we collect about you as described here and in our Privacy Policy.

Ownership of the Site:

Content on this site that is provided by Avengers Cleaning Services, LLC, including photographs, images, graphics, screen shots, texts, downloadable files, trademarks, logos, products, slogans, and the compilation of the foregoing is the property of Avengers Cleaning Services, LLC, and is operated in the U.S. and internationally under trademark, copyright, and other intellectual property laws.

You agree not to copy, republish, reproduce, duplicate, extract, redistribute, sell, rent, license download, edit, display or use any Avengers Cleaning Services, LLC content located on the site for personal or business use in any publications, in public performances, on websites other than this site for any other commercial purposes, in connection with products or services, that are not those of Avengers Cleaning Services, LLC, in any other manner that is likely to cause confusion among consumers, that disparages or discredits Avengers Cleaning Services, LLC, that dilutes the strength of Avengers Cleaning Services, LLC’s property, or that otherwise infringes Avengers Cleaning Services, LLC’s intellectual property rights. You further agree to in no other way misuse any Avengers Cleaning Services, LLC content or third-party content that appears on the site.

We have the right to withdraw or amend this website, and any service or material we provide on the website, in our sole discretion without notice. We will not be liable if for any reason all or any part of the website is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the website, or the entire website, to users, including registered users.

The following requirements apply to your use of the site:

  1. You will not use any electronic communication feature of the site for any purpose that is unlawful, tortious, abusive, intrusive on another’s privacy, harassing, libelous, defamatory, embarrassing, obscene, threatening, or hateful.

  6. You may not use any crawler, spider, scraper, robot, or other automated means of any kind to access or copy data on the site, deep link to any feature or content on the site, bypass our robot exclusion headers or other measures we may use to prevent or restrict access to the site.
  7. You may not use or cause this website to be used, as a medium which stores, hosts, transmits, sends or distributes any material which consists of: spyware, computer viruses, trojans, worms, keystroke loggers or any other malicious computer software.

Violations of system or network security may result in civil or criminal liability. Avengers Cleaning Services, LLC will investigate occurrences that may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations. You agree not to use any device, software, or routine to interfere with or attempt to interfere with proper working of this site or any activity being conducted on this site.

Prohibited Uses:

You may use the Website only for lawful purposes and in accordance with these Terms and Conditions. You agree not to use the Website:

  1. In any way that violates any applicable federal, state, local or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the US or other countries).
  2. For the purpose of exploiting, harming or attempting to exploit or harm minors in any way by exposing them to inappropriate content, asking for personally identifiable information or otherwise.
  3. To transmit, or procure the sending of, any advertising or promotional material without our prior written consent, including any “junk mail “, “chain letter ” or “spam ” or any other similar solicitation.
  4. To impersonate or attempt to impersonate the Company, a Company employee, another user or any other person or entity (including, without limitation, by using e-mail addresses or screen names associated with any of the foregoing).
  5. To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Website, or which, as determined by us, may harm the Company or users of the Website or expose them to liability.

Additionally, you agree not to:

  1. Use the Website in any manner that could disable, overburden, damage, or impair the site or interfere with any other party’s use of the Website, including their ability to engage in real time activities through the Website.
  2. Use any robot, spider or other automatic device, process or means to access the Website for any purpose, including monitoring or copying any of the material on the Website.
  3. Use any manual process to monitor or copy any of the material on the Website or for any other unauthorized purpose without our prior written consent.
  4. Use any device, software or routine that interferes with the proper working of the Website.
  5. Introduce any viruses, trojan horses, worms, logic bombs or other material which is malicious or technologically harmful.
  6. Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Website, the server on which the Website is stored, or any server, computer or database connected to the Website.
  7. Attack the Website via a denial-of-service attack or a distributed denial-of-service attack.
  8. Otherwise attempt to interfere with the proper working of the Website.

Accounts: Passwords

If a particular feature or service offered on the site requires you to open an account, you must complete the specified registration process by providing us with current, complete, and accurate information as requested by the applicable online registration form. It is your responsibility to maintain the currency, completeness, and accuracy of your registration data and any loss caused by your failure to do so is your responsibility. After you have fully completed the registration form, you may be asked to choose a password and a username. It is entirely your responsibility to maintain the confidentiality of your password and account. Additionally, you are entirely responsible for any and all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. You acknowledge that your account is personal to you and agree not to provide any other person with access to this website or portions of it using your username, password, or other security information. You agree to ensure that you exit your account at the end of each session. You should exercise caution when accessing your account from public or shared computer so that others are not able to view or record your password or other personal information. You further agree not to email, post, or otherwise disseminate any user ID, password, or other information which provides you access to the site. Avengers is not liable for any loss that may incur as a result of someone else using your password or account, either with or without your knowledge. We have the right to disable any username, password, or other identifier, whether chosen by you or provided by us, at any time in our sole discretion for any or no reason, including if, in our opinion, you have violated any provisions of these Terms and Conditions.

Transactional Communications:

You agree to receive transactional communications concerning your orders Avengers Cleaning Services, LLC at any of the addresses or phone numbers provided by you or on your behalf—including via e-mail, SMS/text, calls, and push notifications. You agree that SMS/texts, calls or prerecorded messages may be generated by automatic telephone dialing systems. If you change or deactivate the phone number you provided to us, you agree to update your account information to help prevent us from inadvertently communicating with anyone who acquires your old number. The use of transactional SMS/text are governed by our SMS Terms and Conditions. If you do not wish to receive transactional SMS/texts, you can text “STOP” to the ten-digit number from which you are receiving such transactional SMS/texts. You acknowledge that opting out of transactional SMS/text may impact the delivery of the products and services ordered through the Website.

Typographical Errors and Incorrect Pricing:

In the event a product or service is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, we shall have the right to refuse or cancel any orders placed for product/services listed at the incorrect price. We shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit or debit card has already been charged for the purchase and your order is cancelled, we shall promptly issue a credit to your credit or debit card account in the amount of the incorrect price.

Copyright Infringement Notices:

It is our policy to expeditiously respond to notices of alleged copyright infringement that comply with the United States Digital Millennium Copyright Act (“DMCA”). This section describes the information that should be present in these notices and the take down procedure we follow with respect to allegedly infringing material. If we receive proper notification of claimed copyright infringement, our response to these notices may include removing or disabling access to the allegedly infringing material and/or terminating or suspending users. If we remove or disable access in response to such a notice, we will make a good faith attempt to contact the provider of the allegedly infringing content so that they may make a counter notification pursuant to the DMCA. It is our policy to accommodate and not interfere with standard technical measures used by copyright owners to identify or protect their copyrighted works that we determine are reasonable under the circumstances.

If you believe that any content on the Website infringes upon any copyright which you own or control, you may send a written notification to our company’s email with the following information:

  1. A description of the copyrighted work or other intellectual property that you claim has been infringed, with sufficient detail so that we can identify the alleged infringing material.
  2. The URL or other specific location on the Website that contains the alleged infringing material described in (a) above, with reasonably sufficient information to enable us to locate the alleged infringing material.
  3. Your name, mailing address, telephone number and email address.
  4. The electronic or physical signature of the owner of the copyright or a person authorized to act on the owner’s behalf.
  5. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
  6. A statement by you that the information contained in your notice is accurate and that you attest under penalty of perjury that you are the copyright owner or that you are authorized to act on the copyright owner’s behalf.

To notify the provider of the allegedly infringing material to which we have removed or disabled access, we may forward a copy of your infringement notice, including your name and email address to the provider of the allegedly infringing material.

We may terminate users who, in our sole discretion, are deemed to be repeat infringers. Knowingly misrepresenting in a notification that material is infringing can subject you to damages, including costs and attorneys’ fees, incurred by us or the alleged infringer. If you receive an infringement notification from us, you may file a counter notification pursuant with us pursuant to the DMCA. To file a counter notification, please provide our us with the following information:

  1. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed, or access was disabled.
  2. Your name, mailing address, telephone number and email address.
  3. The following statement: “I consent to the jurisdiction of Federal District Court for New Jersey”.
  4. The following statement: “I will accept service of process from [insert the name of the person who submitted the infringement notification] or his/her agent”.
  5. The following statement: “I swear, under penalty of perjury, that I have a good faith belief that the affected material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled”; and
  6. Your signature, in physical or electronic form.

Upon receipt of valid counter notification, we will promptly provide the person who provided the original infringement notification with a copy of your counter notification and inform that person that we will replace the removed material or cease disabling access to it in 10 business days. Further, we will replace the removed material and cease disabling access to it not less than 10, nor more than 14, business days following receipt of your counter notice, unless Designated Agent first receives notice from the person who submitted the original infringement notification that such person has filed an action seeking a court order to restrain you from engaging in infringing activity relating to the material on the Website.

Interactive Chat:

The Website(s) may offer chat or live support functionality (“Chat Functionality”) to better serve you. You should review our Privacy Policy to learn how we treat information that could identify you gathered via the Chat functionality. If you are signed into an Account while using the Chat Functionality, the Chat Functionality may link the Account information with you or the Chat Functionality interaction. You may not impersonate or attempt to gain information regarding another individual via the Chat Functionality. Information provided via the Chat Functionality may be inaccurate, and the Chat Functionality may not always be available or error-free. Service Order Acceptance:

We reserve the right, at our sole discretion, to refuse or cancel any order for services for any reason. Your account may also be restricted or terminated for any reason, at our sole discretion.

Online Payment: Credit Cards:

You can purchase products and/or services on the site. We accept credit and debit cards issued by U.S. banks. If a credit card account is being used for a transaction, Avengers Cleaning Services, LLC may obtain preapproval for an amount up to the amount of the payment. If you want to designate a different credit card or if there is a change in your credit card, you must change your information online. This may temporarily delay your ability to make online payments while we verify your new payment information.

You represent and warrant that if you are making online payments that:

  1. Any credit card, debit card and bank account information you supply is true, correct, and complete.
  2. Charges incurred by you will be honored by your credit/debit card company or bank.
  3. You will pay the charges incurred by you in the amounts posted, including any applicable taxes, rescheduling, or lockout charges.
  4. You are the person in whose name the card was issued, and you are authorized to make a purchase or other transaction with the relevant credit or debit card and its information.

We have taken all practical steps from both a technical and systems perspective based on industry standards to ensure that all of your information is well protected. A secure payment gateway is used to process all transactions and credit card details. Avengers Cleaning Services, LLC does not give any warranty or make any representation regarding the strength or effectiveness of the secure payment gateway and is not responsible for events arising from unauthorized access to your information. Be aware that you may be subjected to the third-party processor’s terms and your information may be subjected to their privacy practices.

Governing Law

These Terms will be governed by and construed in accordance with the internal laws of New Jersey without regard to conflicts of laws principles. By using this site, you hereby agree that any and all disputes regarding these Terms will be subject to the courts located in New Jersey. You agree that, to the extent permitted by applicable law, any and all disputes, claims, and causes of action arising out of or connected with this site and/or these terms, will be resolved individually, without resort to any form of class action. These terms operate to the fullest extent permissible by law.

Arbitration Agreement

Agreement to Arbitrate All Disputes. Except as it relates to qualifying small claims and injunctive relief as explained below, you agree that any and all disputes, controversies, or claims arising between you and Avengers Cleaning Services, LLC (each a “Claim” and collectively “Claims“), including but not limited to Claims arising out of or relating to the Site, use of the Site, these Terms and/or the Privacy Policy, shall be settled by binding and final arbitration in accordance with the then prevailing Comprehensive Arbitration Rules and Procedures of JAMS (“JAMS Rules and Procedures“). The JAMS Rules and Procedures are available at https://www.jamsadr.com/ or by calling (800) 352-5267. The arbitration will be heard and determined by a single arbitrator, who shall be selected pursuant to the JAMS Rules and Procedures. The arbitrator’s decision, judgment, or award in any such arbitration will be final and binding upon the parties and may be entered and enforced in any court having jurisdiction thereof. The Federal Arbitration Act (“FAA“) and federal arbitration law apply to this agreement. The arbitrator shall apply New Jersey law consistent with the FAA and applicable statutes of limitations and shall honor all claims of privilege recognized at law. For the avoidance of doubt, the arbitrator, and not any federal, state, or local court or agency, shall have the exclusive authority to resolve any dispute relating to the arbitrability of any Claims, the scope, applicability, interpretation, and enforcement of this arbitration agreement, and the interpretation, applicability, enforcement, formation of these Terms and/or the Privacy Policy.

Small Claims and Injunctive Relief. This arbitration agreement does not preclude you from pursuing qualifying small claims in small claims court. If your Claims qualify for small claims court, you may still assert your Claims in small claims court so long as the matter remains in such court and advances only on an individual (non-class, non-representative) basis. In addition, you and Avengers Cleaning Services, LLC both retain the right to apply to any court of competent jurisdiction for provisional or injunctive relief, including for pre-arbitral attachments or preliminary injunctions, and any such request shall not be deemed incompatible with these Terms, nor a waiver of the right to have disputes submitted to arbitration as provided in these Terms.

Class Waiver. You may not act as a class representative or private attorney general or participate as a member of a class of claimants with respect to any Claim. Claims may not be arbitrated on a class or representative basis. The arbitrator can decide only your individual Claims. The arbitrator may not consolidate or join the Claims of other persons or parties who may be similarly situated.

Arbitration Costs and Procedures. If you initiate arbitration against us, you will not be responsible for professional fees for the arbitrator’s services or any other JAMS fees. If you are able to demonstrate that the costs of arbitration will be cost-prohibitive as compared to the costs of litigation, Avengers Cleaning Services, LLC will pay as much of your filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the cost of the arbitration from being cost-prohibitive. In the final award, the arbitrator may apportion the costs of arbitration and the compensation of the arbitrator among the parties in such amounts as the arbitrator deems appropriate. Pursuant to the JAMS Rules and Procedures, the arbitration shall proceed in a location determined by the arbitrator (provided that such location is reasonably convenient for you), or at such other location as may be mutually agreed upon by the parties.

Enforcement and Invalidity. If any part of this arbitration provision is deemed to be invalid, unenforceable or illegal (other than that claims will not be arbitrated on a class or representative basis), or otherwise conflicts with the rules and procedures established by JAMS, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, illegal or conflicting provision were not contained herein. If, however, the portion that is deemed invalid, unenforceable, or illegal is that claims will not be arbitrated on a class or representative basis, then the entirety of this arbitration provision shall be null and void, and neither claimant nor Avengers Cleaning Services, LLC shall be entitled to arbitrate their dispute.

This section limits certain rights, including the right to maintain a court action, the right to a jury trial, the right to participate in any form of class or representative claim, the right to engage in discovery except as provided in the JAMS rules and procedures, and the right to certain remedies and forms of relief. Other rights that you or Avengers Cleaning Services, LLC would have in court also may not be available in arbitration.

Termination

Avengers Cleaning Services, LLC may, in its sole discretion, and at any time, discontinue this Site or any part thereof, with or without notice, or may prevent your use of this Site with or without notice to you. You agree that you do not have any rights in this Site and that Avengers Cleaning Services, LLC will have no liability to you if this Site is discontinued or your ability to access the Site or any content you may have posted on the Site is terminated.

Other Terms

Any other terms of service or return and warranty policies on our Site are hereby incorporated by reference into these Terms.

Miscellaneous

These Terms constitute a binding agreement between you and Avengers Cleaning Services, LLC and is accepted by you upon your use of the Site or your account. These Terms constitute the entire agreement between you and Avengers Cleaning Services, LLC regarding the use of the Site and your account. Both you and Avengers Cleaning Services, LLC acknowledge and agree that no partnership is formed and neither of you nor Avengers Cleaning Services, LLC has the power or the authority to obligate or bind the other. If Avengers Cleaning Services, LLC fails to act with respect to your breach or anyone else’s breach on any occasion, Avengers Cleaning Services, LLC is not waiving its right to act with respect to future or similar breaches. If any provision of these Terms shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these terms of use and shall not affect the validity and enforceability of any remaining provisions. Avengers Cleaning Services, LLC may assign this agreement, in whole or in part, at any time with or without notice to you. You may not assign this agreement, or any part of it, to any other person. Any attempt by you to do so is void.

Satisfaction Guarantee:

Your satisfaction is our top priority, and we strive to always do an exceptional job that exceeds our client’s expectations.

While we strive for perfection, we understand it is not always possible, which is why we back all of our work with a 24-hour 100% Satisfaction Guarantee. In the rare event that you are not 100% satisfied with the job, we are happy to correct our mistakes and make things right at no additional cost to you when you contact us within 24 hours from the completion of your service. Just give us a call within 24 hours of your cleaning and we will return to re-clean what was missed at no cost to you.

This guarantee does not apply if the cleaning team cannot get the job completed due to but not limited to excessive clutter, lack of running water or electricity, contractors performing work in the home, heavy furniture etc.

Fully Insured and Bonded:

Avengers Cleaning Services, LLC is fully insured and bonded. We have the best available insurance and bonding for the following:

  1. Auto Insurance for company’s vehicles and drivers.
  2. Worker’s Compensation in the event of an employee’s injury.
  3. Accident coverage in the event that any damage occurs at the customer’s property.
  4. Bonding to compensate homeowner in case of theft if the person responsible is convicted.

Certificate of Insurance can be provided upon request.

Communication:

Excellent communication and feedback are the key excellent customer service. We try our best to clearly communicate the scope of service, our policies and to manage expectations.

If we are not meeting your expectation or failed to communicate clearly, please call, or email us to discuss. We appreciate all the feedback to help us improve our quality of service.

Special Instructions:

If you have any special instructions, please provide these instructions at least 72 hours prior to your booking. Please note that we will try to accommodate all special requests if they are submitted at least 72 hours prior to your booking based on scheduling availability. Our professional cleaners are not able to take special requests at the time of the job unless the schedule and availability permits.

The Same Team:

We believe it is very important to always send the same team to clean your home, so we make every effort to have the same team clean your home each visit. Occasionally there may be a change in a team member due to illness, vacations, and staff changes. The team leader’s job is to learn about your home, be familiar with it, know your home cleaning needs and train and communicate with the other team members to ensure delivering high quality service that exceeds your expectations.

All of our cleaning professionals undergo extensive and ongoing training to ensure that the quality of our service is always consistent every single time no matter which team is servicing your home.

First time customers will not be able to request a specific professional cleaner, but returning clients will be able to request it.

Please note that if you request a specific cleaner, the availability for your next clean may not be as broad because it is restricted to when your particular cleaner is available.

Office Hours:

We are open Monday to Friday 8am-7pm. Voicemail and emails are reviewed and answered during normal business hours.

Equipment and Supplies:

For your convenience, we will supply all necessary supplies and equipment. We will arrive with all of the cleaning materials we need and take them with us when we leave. We are proud to use the best cleaning products and equipment available on the market to ensure that we leave your home sparkling clean.

Green Cleaning is our company’s standard. Our Green Cleaning involves the practices and products that promote a better environment and a healthier home. For each cleaning appointment and house, we use fresh, clean mop pads, Swiffer duster heads and microfiber color-coded cloths to avoid cross-contamination.

The only item that we prefer you provide is a toilet brush.

If you have any preferences regarding what cleaning products we use, feel free to let us know and we will do everything we can to accommodate your requests.

Quality Control:

Our professional cleaners are fully trained and insured, and they undergo regular training to ensure they are always up to date with all the latest and greatest cleaning techniques.

Our professional cleaners go through extensive training before they start working with us. Training is always ongoing as new products and methods emerge on the market.

Each team has a Team Leader who supervises the team on site and completes a quality check throughout the service. A field manager or Team Leader also performs quality checks and home inspections to ensure that you receive the best possible service and highest quality clean.

Supervisors and managers do random Quality Assurance inspections to ensure that our professional cleaners are providing top-quality cleaning services that exceed all of our customers’ expectations.

Our professional cleaners respect all of our customers by never smoking, drinking, eating or using appliances during your home cleanings.

You will receive a quality survey after each cleaning to get feedback about how we did.

In the rare event that you are not 100% satisfied with the job, we are happy to correct our mistakes and make things right at no additional cost to you when you contact us within 24 hours from the completion of your service.

Arrival Window:

When you schedule a cleaning service appointment with us, we will give you an arrival timeframe of three to four hours. Because we give homes the attention they deserve and we strive to do an exceptional job, we are not able to provide an exact time of arrival, but we do our best to ensure that our cleaning plan and arrival time is as close as the scheduled time as possible to minimize interference with your schedule.

We often encounter things that delay our arrival at our next home, such as traffic, customers who would like some additional help and unexpected late notice of cancellation. Please remember that these things are out of our control.

Entering Your Home:

Your home must be easily accessible to our team. We will wait for up to 15 minutes before charging a lockout fee equal to the cost of that day’s appointment. To ensure easy access, please choose one of these options:

You may give us a key to be safely stored in a client key safe that is ONLY accessible by the office manager:

  1. On the day of your cleaning appointment, Team leaders are given the keys for each house cleaning appointment before they leave the office and must return these keys back to management before they can leave the office at the end of each day.
  2. These keys are returned and kept secured in the keys safe until your next house cleaning service appointment.

We can provide you with a lockable key holder box that can be mounted somewhere on the premises. You must provide us with a spare key in the locked box and our team will have access to it.

You can provide us with your smart-lock access code.

Please provide our team with the alarm code and the proper instructions. You can create a single-use (guest) or a temporary access code for our team to use.

Exiting Your Home:

We make every reasonable effort to secure your door lock and arm the security alarm. We cannot accept responsibility for securing doors and locks that are not fully functional or if

We were not provided with the proper exiting instructions.

Preparing your home for your cleaning appointment:

To ensure maximum efficiency and the best use of our time, we ask you to pick up household items such as clothing, toys, laundry, books, magazines, dishes, papers, shoes, glasses, and clutter before we arrive. This allows us to move through your home more quickly, which can help you save on costs since this reduces the time needed for our team to clean. Leave fresh linens out so we can change the bedding and towels.

Please put away any important documents and valuable possessions.

We also ask you to find a place for your pets, so they are comfortable while we clean.

Please provide us with instructions on handling pets, keys, alarms, entering and existing your home.

Provide us with any special requests so we can bring any special cleaning supplies or equipment to accommodate your request. If you would like us to use specific products or equipment, please let our team know during the walkthrough or at least 72 hours in advance.

Following through with these requests will help your family save money on costs, have a fresh and sparkling clean home and will help our team to do an exceptional job that exceeds your expectations.

Safety:

Insurance and safety issues prohibit our teams from moving heavy objects or standing on furniture. Our team is barred from handling any biohazard, including pet or human fluids, rodent feces, mold, etc. We may only use a 2-step ladder and extension poles to reach items in your home and cannot climb onto anything higher.

Heating/Cooling:

OSHA recommends a temperature setting of 70F-74F. Teams prefer COLD/HIGH settings for all wall units – cleaning is an aerobic activity and we easily heat up. We reserve the right to refuse service if the unit temperature is unbearable for onsite cleaning staff and/or may turn on your heating or cooling system while working.

Move or lift items weighting more than 35 lbs. unassisted:

We are happy to clean behind furniture that is easily accessible. Please ensure that these items have felt floor protectors applied to all leg corners – we are not responsible for floor scratches resulting from furniture that lacks protective covers.

Our team does not lift any items heavier than 35 lbs.

Moving Appliances:

We do not move any appliances that are connected to water or gas.

Security Alarms:

If your home has a security alarm, please ensure that it is turned off on the day of your scheduled cleaning. You may also provide us with the code and steps necessary to turn off your alarm. We will reset the alarm when we leave. We cannot be held responsible for alarms set off by mistake.

Pets:

We love animals but even the friendliest dog can become nervous when the vacuum gets going. Our safety, and your pets’ comfort are important. We ask that your pet is restrained and/or that you are home to supervise until pets and team members are accustomed to one another. We cannot be held responsible for unsecured pets when entering, exiting, or actively working in an appointment. If our team members feel threatened by your pet’s behavior, we will exit your home and you will be charged for the full amount of the appointment. For sanitary and safety reasons our team is not permitted to clean flea infested homes or pick up animal excrement.

Emergency Weather Closings:

There may be times when weather makes it unsafe for us to transport passengers and equipment to your home. We generally follow the local school system for weather related closures and will reschedule your cleaning appointment as soon as we possibly can. We appreciate your understanding in these circumstances.

Billing:

We accept all major credit cards. Invoices can be used for commercial accounts. We securely and safely keep your card on file and charge that card the day prior to your cleaning date. We cannot be held responsible if the payment causes an NSF on your account.

Late fee: If payment is not received within 3 days, we will add a $25 late fee and continue attempting to charge your credit card on file. 

Sales Taxes: We are required to collect and submit Sales Tax in states which require it, and the rate may be revised annually. 

Charing Your Card on File: We reserve the right to charge your card at any time.

Tipping:

While tips are not expected, we are allowed to accept them. Some of our clients prefer to tip a little at the end of each service while others tip a larger amount at the end of the year. You can also leave a review on Google or any social media platform. We love to hear how much our work is appreciated.

If you decide to leave a Google or any social media review, make sure to mention the cleaner’s name or cleaners’ names if possible. These reviews help them earn a bonus at the end of the month.

Tipping is not included in our cleaning prices.

You can tip the team in cash.

Tips given to our cleaning team are shared and split among the team members.

Refunds:

We do not offer refunds. In the rare event that you are unsatisfied with your cleaning, contact us within 24 hours of the completion of your service and we will offer you a re-clean at a time that suits you, free of charge as a part of our 100% Satisfaction Guarantee policy.

Rescheduling or Cancelling Your Cleaning Appointment:

We understand that sometimes life can be unpredictable and unexpected situations and emergencies happen. If something comes up, please call our office during regular business hours, and notify us as soon as possible to avoid any fees. You can also login into your dashboard and reschedule, skip, or cancel your cleaning appointment. We will do everything we possibly can to fit another cleaning in the time slot that was reserved for you. If we are unable to, then a cancellation or rescheduling fee will be charged as indicated below.

If you cancel or reschedule within 24 hours, you will be charged 50% of the total cost of the job.

If you cancel or reschedule within the same business day and during business hours, you will be charged the total cost of the job.

Recurring customers will have one rescheduling/cancellation fee waived every 90 days.

NOTE:  All cancellations will also cause the rate for your next cleaning to increase to the next level [example – if you are serviced weekly and you skip a service, you will have to pay the bi-weekly rate for your next cleaning, if you are serviced bi-weekly and you skip a service you will pay the monthly rate for you next cleaning].

If you are a regular client with a recurring service, you still need to cancel an appointment prior to the deadlines mentioned above or a fee will be applied. You may cancel all later and future appointments with no additional fee.

Suspension Of Service/Liability of Fees:

If any of the above fees have not been paid your service will be suspended until all fees have been paid in full. If service is suspended and you have not paid in full within 15 days, we will consider you to have terminated service. In addition to any amounts owed to Avengers Cleaning Services, LLC, you agree to be responsible for all collections and attorney’s fees we incur to bring your account current.

Service Cancellation:

It is agreed that this is an at-will relationship and that no contract term is implied, and service may be canceled at any time. To avoid a late cancellation charge of $100 at least 72- hours’ notice is required via email or online self-serve portal. We reserve the right to cancel your appointment for any reason and at any time. Examples of this have included infestations and rude or disrespectful behavior to our team members. You will be assessed the full price of your cleaning appointment should we cancel your service on the day of your appointment. 

Holidays:

We are closed on the following holidays – if you have an appointment scheduled for these days, it will be coordinated with you and rescheduled in advance:

  • Fourth of July
  • Labor Day
  • Thanksgiving
  • Christmas
  • New Year Day

Damages:

Reporting: our staff is instructed to report incidents immediately to our office and we will contact you. Should you uncover damage, we must be contacted within 24 hours of your appointment. We cannot be responsible for damage reported beyond this time frame.

Sentimental / High Value / Heirloom Items: are best cleaned by our clients. You are responsible for letting us know if there are such items in your home so that we can instruct our staff not to touch them.  We cannot take responsibility for cleaning or damage to these items if they have not been pointed out to us.

Liability: Avengers Cleaning Services, LLC’s liability is limited to a refund of the amount paid for the service rendered on the date the damage occurred. Avengers Cleaning Services, LLC — at its sole discretion and without admitting liability — may offer to replace or repair the property in lieu of a refund. Avengers Cleaning Services, LLC will choose the method, manner and service provider for repair or replacement. Above that you will need to file a claim with your homeowner’s insurance for damage caused in the routine nature of cleaning. Damage due to negligence will be referred to our insurance provider.

No Responsibility For: we assume no responsibility for damage to items that are loosened, inadequately secured, or mounted, negligently placed, excessively worn or in poor repair.

Photos Of Your Home: Avengers Cleaning Services, LLC has the right to take photos in your home to communicate damages for our protection.  Photos will be limited to the item/issue involved and are for the sole purpose of communication to management and to you and to document/showcase our before and after work. 

Dishes: We’re happy to clear the sink of dirty dishes by loading them into the dishwasher but we do not hand wash dishes to avoid breaking anything.

Suspected Theft:We conduct background checks and screen our staff prior to hiring. We closely monitor their attitude, behavior, and performance.  We want to assure you that we will cooperate fully if you suspect that property is missing from your home. In this event:

a)Contact Us Immediately:we’ll talk to the staff.They may have noticed the item in an unusual place, mistakenly moved it or relocated it for safekeeping as they worked.

b)Search Your Home Carefully: Most of us misplace things from time to time, so please give a second look around.

c)File A Police Report: If you conclude that an item has been removed, contact your local police department; file a report and request an investigation.

Interruptions:

Our goal is to do a job that exceeds your expectations and do it efficiently. If you are home when we come to clean, we do ask you not to be in the rooms we are cleaning to allow our cleaners to clean efficiently and effectively.

We typically do not do the following services:

  1. Doing laundry, ironing, and folding.
  2. Chandeliers or High light fixtures.
  3. Cleaning biohazards: mold, blood, bodily fluids, feces etc.
  4. Animal waste.
  5. Insects and/or rodents, fleas, bedbugs etc.
  6. Heavy scrubbing of walls/doors.
  7. Lifting or moving heavy items requiring more than 1 person.
  8. Rust removal/rust cleaning.
  9. Hoarding.
  10. Strip cabinet liners.
  11. Mold removal.
  12. Cleaning unfinished basement.
  13. Cleaning pest-infested homes (fleas, roaches, bedbugs etc.).
  14. Move appliances that are connected to gas or water.
  15. Picking up, removing and organizing clutter.
  16. Washing dishes.
  17. Cleaning toys.
  18. Cleaning inside of fireplaces.
  19. Cleaning TV or other screens (we only dust these surfaces).
  20. We do not want to misplace any of your belongings, which is why we leave these organizational tasks to you.
